HIPAA Privacy Notice
- Blackhawk certifies that members proprietary health information is properly secured during all exchanges required to provide individuals with high quality health care.
- Blackhawk is committed to HIPAA’s purposes, and its required protections for consumers.
- The following are situations and purposes we may disclose or use your health information without authorization:
- Payment: In cases where it is necessary to collect premiums, pay claims, or provide eligibility information to a provider we may disclose or use your health information.
- Treatment Purposes: At a physician’s request, we may disclose health information for your treatment.
- As Required by Law: For example, audits may be conducted by the U.S. Department of Health and Human Services and health information may be required to comply with workers compensation or similar laws.
- Healthcare Operations: Your health information may be used in the creation, renewal, or replacement of a healthcare plan and disclosed to authorized partners to perform services including care management and data aggregation. We may also use health information to contact you to provide relevant treatment alternatives or health benefits.
- To Business Partners: Health information may be shared with relevant partners during operation of our business. Each partner securely and confidentiality handles health information.
- To Plan Sponsor: Claims history and similar information may be supplied to plan sponsors under required circumstances and for administrative functions. Claims and summary information will not provide names or other identifying information to the plan sponsor. We may also provide plan sponsors with information regarding your enrollment status in the plan.
- We may also use and disclose your health information to:
- Government agencies authorized to oversee healthcare systems, law enforcement officials and legal proceedings
- Your personal representatives as authorized by law or the purpose of assisting your healthcare and/or payments
- Recipients with a data use agreement who meet regulatory requirements.
- Or to protect your immediate health or safety.

- As required by law, we will maintain the privacy of your health information under any communication medium and notify you if a breach of your health information has occurred.
- You may request in writing any of the following regarding your health information:
- To receive copies of your health information. In specific circumstances, we may not be required to comply with your request.
- To correct your health information. In specific circumstances, we may not be required to comply with your request.
- To request alternative confidential communication channels during the discussion of your health information. We reserve the right to deny your request unless the suggested channel is for your immediate protection against endangerment.
- To receive disclosures of your health information that we have made for the last six years.
- To add restrictions on our use your health information. We reserve the right to deny your request under 45 C.F.R. Section 164.522(a)(1)(vi).

- If you want to exercise any of these rights described in this notice, please contact us. We will respond with the necessary actions required to complete your request. We may charge a cost-based fee to fulfill your request.

- You have the right to submit complaints directly to us or the Secretary of the U.S. Department of Health and Human Services if you believe there has been a violation of your privacy rights.
